Structures de moyens

Sont des Structures de Moyens :

la société civile de moyens (article 36 de la loi SCP),
le groupement d’intérêt économique,
le groupement européen d’intérêt économique,
la convention de cabinets groupés,
la convention de correspondance organique nationale,
la convention de correspondance organique internationale,
la convention ou les statuts d’association ayant pour objet la mise en place d’un réseau national ou international, dans le respect de l’article 16.4.

Les Structures de Moyens ont pour objet ou finalité exclusifs de faciliter ou de développer l’activité professionnelle de leurs membres; leur activité doit se rattacher à l’activité économique de leurs membres et ne peut avoir qu’un caractère auxiliaire par rapport à cette activité. La Structure de Moyens ne peut exercer elle-même la profession d’avocat. La participation à une Structure de Moyens doit se faire dans le respect des Principes Essentiels, les avocats membres d’une Structure de Moyens étant en outre soumis entre eux aux mêmes règles que les avocats membres d’une Structure d’Exercice en matière de conflits d’intérêts.

Tout membre d’une Structure de Moyens doit éviter toute présentation de cette Structure de nature à faire croire aux tiers qu’il peut s’agir d’une Structure d’Exercice et se conforme aux dispositions de l’article 10.4 alinéa 5.
